         Het DCC heeft bij het uitvoeren van haar crisisbeheersingstaken m.b.t. orkaan Irma in Caribisch Nederland opdrachten verstrekt aan marktpartijen voor directe noodhulpverlening. Het gaat in dit kader om de inzet van een waste train (inclusief bediening en transport).

         Aangezien het hier ging om noodhulp aan Caribisch Nederland zijn deze opdrachten met spoed verstrekt, want er waren geen bestaande overeenkomsten voor bovengenoemde opdrachten. In de Aanbestedingswet (AW) staat aangegeven dat bij onvoorziene dwingende spoed de onderhandelingsprocedure zonder aankondiging toegepast kan worden (artikel 2.32 lid 1 sub c AW). Dit is bij de betreffende opdrachtverlening van toepassing geweest, want vanwege dwingende spoed was het niet mogelijk om de opdracht op de gebruikelijke wijze aan te besteden. Het ging tevens over een gebeurtenis die door de aanbestedende dienst niet kon worden voorzien en niet aan de aanbestedende dienst is te wijten.
